Daily Metronome — Terms of Service
These Terms of Service ("Terms") govern your use of Daily Metronome, a music practice companion offering a metronome, PDF sheet music import, practice presets, and practice recordings ("the App"), published by Atlas Peak ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, reverse-engineer, or lease any part of the App.
2. Purchases & Subscriptions
The App is free to download and includes core features at no cost. Optional premium features are available through Daily Metronome Pro, an auto-renewable subscription:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel subscriptions in your device Settings → your name → Subscriptions.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- Pricing and trial eligibility are shown in the App before purchase and may vary by region.
All payments and refunds are processed by Apple. To request a refund, visit reportaproblem.apple.com.
3. Your Content
Pdf sheet music you import and practice recordings you create are stored on your device and are not uploaded to atlas peak servers. You are responsible for ensuring you have the right to use any materials you import into the App, and for keeping your own backups.
4. Acceptable Use
You agree not to use the App in any way that violates applicable law, infringes the rights of others, or attempts to disrupt, probe, or gain unauthorized access to the App or related services.
5. Intellectual Property
The App, including its design, code, graphics, and content (excluding content you import), is owned by Atlas Peak and protected by copyright and other intellectual property laws.
6. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free.
7. Limitation of Liability
To the maximum extent permitted by law, Atlas Peak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.
8. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by deleting it from your device.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated effective date on this page. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the United States and the state in which Atlas Peak operates, without regard to conflict-of-law principles.
